【仲裁条款范例】仲裁协定

1.1争议之前

仲裁协定一般都含在经贸合同中，作为与合同其他条款分离，独立存在的一个或数个条款，如：

12.Any dispute or difference arising out of or in connection with this contract shall be determined by the arbitration of

凡因本合同而产生或与本合同有关的一切争议或分歧，均应提交

A single arbitrator who failing agreement shall be appointed by the President or a Vice-President of the (Chartered Institution of Arbitrators)

由一名仲裁员独任审理，如当事双方就仲裁员的指定不能达成协议，其应由(专门的仲裁机构)主席或副主席予以指定。

Or

或

one arbitrator to be appointed by each party together(if they disagree)with an umpire who failing agreement between such arbitrators shall be appointed by the President of the Chartered Institution of Arbitrators)on the application of either party.

由双方当事人各自指定一名仲裁人审理，(如他们不能达成协议)，则应连同经一方当事人提请，由(专门的仲裁机构)的主席指定的一名首席仲裁人(如两仲裁人就首席仲裁人的指定意见不一)一起共同裁定。

或

one arbitrator to be appointed by each party together(if they disagree)with a third arbitrator who shall be appointed by the President or a vice-President of the(Chartered Institution of Arbitrators)

由双方当事人各自指定一名仲裁员(如他们不能达成协议)，则应连同由这两名仲裁员指定的或由(专门的仲裁机构)的主席或副主席指定的(如两仲裁人就指定一事达不成协议)另一名仲裁人一起共同裁定。

13.The right of appeal conferred by section 1of the Arbitration Axt 1979 and the right to make an application under section 2 there of are hereby excluded in relation to any arbitration connenced under this agreement or any award made there in

根据本合同规定所提起的任何仲裁或作出的任何裁定将排除1979年《仲裁法》所规定的上诉权和该法第二条所规定的申请权。

14.where by this clause any dispute or diffence is to be referred to arbitration the making of an sward shall be a condition precedent to any right of action by either party against the other.

一旦按本条款之规定将争议或分歧提交仲裁，必须待作出裁定后，一方当事人方享有对另一方当事人提起诉讼的权利。

15.Any claim for damages gor breach of this agreement shall be made in writing and shall be served upon the airy against whom the clain is made no more than--month(s) from the dare of the breach and in default any such claim shall be deemed to have been abandoned and shall be absolutely barred.

任何因违反本协议而提出的索赔主张均应作成书面，并于违约之日起的(______)月之内送达给被主张一方当事人，如不按此规定办理，该权利主张将被视为放弃而遭仲裁委员会完全拒绝。

16.The arbitration shall be held in (place) and the dispure shall be decided in accordance with (English) law .

仲裁将在X地举行，争议将根据(英)国法予以裁定。

17.The arbitration shall be conducted in accordance with the Rules of the Chartered Institution of Arbitrators.

仲裁将按专门的仲裁机构规则进行。
